ANOTHER VICTORY OF THE ARBITRATION BRANCH OF “LINNIKOV & PARTNERS”

11.10.2021 Dmitry Smola, one of the leaders of the arbitration practice of “Linnikov & Partners”, won a convincing victory in the arbitration court of one of the Volga regions, having achieved, within the framework of bankruptcy proceedings, a refusal to bring to subsidiary liability persons who were part of the management of a large legal entity. The bankruptcy managers tried to charge these persons with bringing the company to bankruptcy, approving the annual statements of the debtor company, which contained distorted information. During the trial, the reasons for the circumstances that led the debtor to bankruptcy were clarified, as well as the degree of presence or absence of guilty actions on the part of each of the controlling persons. Thanks to a professionally constructed position on the merits of the dispute, the non-involvement of the principals of “Linnikov & Partners” in the bankruptcy of the specified legal entity was proved.
