ROUND TABLE IN THE FEDERATION COUNCIL “THE USE OF MEDIATION PROCEDURE IN THE CONSIDERATION OF CASES BY THE COURTS”

18/11/2024, Tatyana Tsepkina took part in a round table meeting on the use of mediation procedures in court proceedings, organized by the Federation Council Committee on Constitutional Legislation and State Building, held in the Federation Council.

 

The meeting was attended by senators, representatives of the Ministry of Justice of Russia, the Presidential Council for the Development of Civil Society and Human Rights, the office of the Supreme Court of the Russian Federation, the Court of Intellectual Rights, the Russian Union of Industrialists and Entrepreneurs, representatives of the legal, scientific and expert communities, professional mediators.

 

During the round table, various areas of mediation as an alternative way of settling disputes, problems of legal regulation of the mediation institute, the participation of lawyers and notaries in conflict resolution, the role of the court in informing the parties about the advantages of mediation, and the experience of mediation development in China were considered.

 

Following the results of the round table, the participants noted the relevance and importance of the issues raised, and suggested directions for further development of mediation.

 

Our team has a very interesting experience of participating in alternative procedures as arbitrators and representatives of the parties, both in Russia and abroad. Moreover, the founder and head of L&P, Alexander Linnikov, Leonid Karpov and I are acting arbitrators of the Arbitration Center at the Russian Union of Industrialists and Entrepreneurs. Thus, in the case of an objective possibility of resolving a legal conflict without recourse to a state court, in order to save procedural and economic costs, we recommend alternative procedures to our clients, including with the participation of a mediator. I would like to note that the skills of the mediation approach that I acquired at St. Petersburg State University under the program “Mediation in conflict resolution” help me in my professional activity when advising clients,” says Tatyana Tsepkina.
