L&P TEAM WINS A COMPLEX LABOR DISPUTE

On 19.05.2017 one of Moscow district courts put an end to an intense labor dispute that turned out to be one of the most complex and intricate in the practice of Linnikov & Partners.
The dispute balanced on the edge between Russian and foreign labor law. An employee of the Moscow representative office of a prominent international corporation terminated several years ago unlawfully attempted to recover the salary for the whole period following his dismissal in the total amount exceeding 40 million Rubles. The plaintiff’s claim was based on the false allegations that the labor relationship had not been formally terminated.
In close co-operation with foreign colleagues have made a great effort to locate, recover from abroad and submit to the court the decisive proof that completely dismantled the plaintiff’s illegal and unjustified claim. Gradually, in course of more than six months, the professionals of Linnikov & Partners consistently and completely discredited the plaintiff’s unlawful claim in front of the court.
After having thoroughly examined the evidence submitted by the defense, the court has ruled most allegations of the ex-employee unlawful and unjustified and denied the outrageous claims.
